Contractor Terms
The agreement between contractor partners and RoofingEstimates.ai.
These Contractor Terms ("Contractor Terms") govern your participation as a roofing contractor partner ("Contractor," "you") in the RoofingEstimates.ai lead distribution program (the "Program") operated by RoofingEstimates.ai ("we," "us," "our"). By creating a contractor account, you accept these Contractor Terms.
1. The Program
RoofingEstimates.ai operates a website that helps homeowners get instant, AI-generated roof measurements and price estimates. After receiving an estimate, the homeowner is connected with up to three (3) licensed local roofing contractors so they can receive a binding quote. You will receive distributed leads from homeowners whose property is within your service area, subject to your account caps and our quality controls.
2. Eligibility
To participate, you must:
- Be a properly licensed and insured roofing contractor in the states where you operate.
- Be authorized to enter into binding contracts on behalf of your company.
- Provide accurate company, license, and contact information.
- Maintain workers' compensation insurance and general liability coverage as required by law.
3. Lead Pricing
Each lead distributed to your account incurs a flat per-lead fee. The current fee is shown on your dashboard ("Cost Per Lead"). We may adjust pricing with at least thirty (30) days' notice via email or dashboard banner. Fees are deducted from your account balance at the time the lead is distributed, regardless of whether the lead converts.
4. Account Funding & Auto-Reload
You must maintain a positive account balance to receive leads. You may add funds through your dashboard via Stripe-processed card payments. The minimum reload is $500. Funds added are non-refundable except as described in Section 5.
Auto-Reload Authorization
By adding funds to your account, you authorize RoofingEstimates.ai (via our payment processor, Stripe) to:
- Save the payment method you provide for future use; and
- Automatically charge that saved payment method $500 (USD) whenever your account balance drops below $100 (USD), in order to keep your account funded for ongoing lead delivery.
You may modify the Auto-Reload threshold and amount, disable Auto-Reload entirely, or remove your saved payment method at any time from the Account & Billing section of your dashboard. You may also pause lead delivery or deactivate your account, both of which prevent further charges. Disabling Auto-Reload does not refund prior charges; please review Section 5 for refund eligibility.
If an Auto-Reload attempt fails (for example, card declined or expired), Auto-Reload will be automatically disabled on your account and we will email you. You will need to add a working payment method to resume.
5. Refunds & Lead Quality
Refund-eligible leads include: (a) duplicate of a lead already distributed to you within the prior 30 days, (b) phone number cannot be reached after 5 documented attempts (and the homeowner did not return contact), (c) homeowner is not the property owner, (d) property is outside your declared service area, or (e) the lead was the result of a verified system error on our end.
Refund requests must be submitted within 7 days of lead distribution via the dashboard, with documentation. We will review and credit your account within 5 business days.
6. Use of Lead Information
You agree to use lead information ONLY to provide a roofing quote or related services to the specific homeowner who submitted the request. You agree NOT to:
- Resell, redistribute, or transfer lead information to any third party.
- Use lead information for any purpose other than quoting that homeowner's project.
- Continue contacting a homeowner after they have asked to stop.
- Send marketing communications outside the scope of the homeowner's request.
7. SMS Notifications & A2P Disclosure
By providing a mobile phone number for SMS notifications and checking the SMS consent box at signup (or by adding additional SMS recipients in your dashboard), you (and the recipient) consent to receive SMS messages from RoofingEstimates.ai about new leads, account activity, and operational alerts.
Message frequency varies and depends on lead volume in your service area. Standard message and data rates may apply. Reply STOP to opt out, HELP for help. See our SMS Terms for full disclosure.
You represent and warrant that any phone number you add as an SMS recipient belongs to a person who has consented to receive these messages from RoofingEstimates.ai. You agree to indemnify us for any TCPA, A2P, or carrier violation claims arising from numbers you add without proper consent.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in consent and phone numbers will not be sold, rented, or shared with third parties for marketing. Consent to receive SMS messages is not a condition of using the platform.
8. Privacy & Data Handling
You will treat homeowner information as confidential and protect it with reasonable security measures. You will not store, share, or use homeowner information in ways that violate the homeowner's privacy rights or applicable law (including TCPA, CAN-SPAM, GLBA, state privacy laws). 9. Service Standards
We expect contractors to:
- Respond to new leads within 1 business hour during business hours.
- Provide professional, accurate quotes after physical inspection.
- Honor all advertised warranties and guarantees.
- Comply with all applicable building codes and licensing requirements.
- Maintain a customer satisfaction record consistent with industry norms.
We may suspend or terminate accounts that consistently fail these standards, that receive multiple verified complaints, or that engage in deceptive practices.
10. Account Termination
You may close your account at any time via the dashboard. We may suspend or terminate your account for violation of these Contractor Terms, fraud, non-payment, or any conduct that harms the integrity of the Program or our users. Upon termination, your remaining account balance (after any outstanding charges) will be refunded within 30 days.
11. Independent Contractor Relationship
You and RoofingEstimates.ai are independent parties. Nothing in these Contractor Terms creates a partnership, joint venture, employer-employee relationship, or agency. You are solely responsible for your own employees, subcontractors, taxes, licensing, and insurance.
12. Disclaimers
WE DO NOT GUARANTEE LEAD VOLUME, LEAD QUALITY, OR CONVERSION RATES. THE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. AI-GENERATED MEASUREMENTS ARE ESTIMATES AND MUST BE VERIFIED ON-SITE BEFORE QUOTING.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE PROGRAM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 90 DAYS PRECEDING THE CLAIM. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS.
14. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including attorneys' fees) arising from: (a) your work for any homeowner, (b) your violation of these Contractor Terms, (c) any TCPA/A2P/CAN-SPAM/privacy law violation related to numbers or addresses you have added, or (d) your violation of any law or third-party right.
15. Changes to These Terms
We may update these Contractor Terms with at least 14 days' notice via email or dashboard. Continued use of the Program after the effective date constitutes acceptance.
16. Governing Law
These Contractor Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts of Douglas County, Nebraska.
